Enable My Child, dba, HelloHERO (the “Company” or “we”) recognizes the importance of keeping your personal information private. The purpose of this Privacy Policy is to describe how the Company collects, uses, and shares information about you through online interfaces owned or operated by the Company and related electronic communications.

This Policy does not apply to https://thebrain.hellohero.com/login, which is a propriety platform requiring a user specific credentials. This Policy does not apply to any website owned or operated by or communications sent by any third party, even if such third party website or communication links to the Site or if the Site or communication contains links to the third party website. Please pay attention when you leave our Site and read and understand the privacy statements of those third party websites that may also collect your personal information.

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Disclosure of Your Personal Data

Student Data

In our role as a vendor to educational agencies and institutions (EA) we receive student data that is used in the platform in order to provide services to students. Only information that is needed by us to perform services to the student as agreed by the EA is disclosed to us. These disclosures are authorized under the Family Educational Rights and Privacy Act (FERPA), as a contractor to the EA, we receive the disclosures on the same basis as school officials employed by the EA, consistent with FERPA regulations, 34 CFR §99.31(a)(1)(i)(B). Consistent with those regulations, we have a legitimate educational interest in the information to which we are given access because the information is needed to perform the service, and we are under the direct control of the EA in using and maintaining the disclosed education records, consistent with the terms of its contract. Student data is at all times it encrypted, during transmission and at rest. At all times student data is confidential and only use student data to provide services on the platform. Only a select number of individuals, who need the data in order to provide services, have access to the student data on the platform. We will not sell or otherwise use or redisclose student data or education records for targeted advertising or marketing purposes. We do not allow advertising within the platform, and therefore there is no behavioral or targeted advertising.

Children’s Privacy

We do not knowingly collect any personal information from children under the age of 13 without parental consent. Any information we collect from children is entered by an adult in the platform by either a school official, clinician or pediatric coach. While students have access to their profile information, it is strongly discouraged by HH staff and Service Providers to allow students under 13 to updated personal information. Authorized representatives, school representatives, clinicians, and pediatric coaches may enter/update personal information into our platform. Student access to the platform is only granted to students by an educational agency or institutions (EAs) which contract to receive services. Children under the age of 13 receiving Family Services have been granted access by the authorized representative who enrolled the child in the Family Services product. If we learn that a child under the age of 13 has provided us with personal information on Site (excluding the platform), we will delete it in accordance with applicable law.

Your California Privacy Rights

California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
